Why careful review matters

A solar lease is not a seasonal farm lease. It can run thirty to forty years, change hands several times, and bind your heirs.

These agreements are drafted by the developer's counsel to protect the developer, not to protect you. That's where a lawyer representing the landowner comes in.

Signing the option often binds you to a multi-decade lease

Option agreements typically attach the full lease. Once signed, its terms are largely fixed for you, while the developer retains the right to withdraw. Negotiation must begin before the first signature.

A long-term contract carries long-term risk

Projects are sold, companies merge, and some fail. A well-drafted lease secures the removal of equipment and restoration of the land, regardless of who owns the project.

You may have more leverage than you think

Landowners often do not know what to ask for, and may miss out on favorable terms that help protect their finances and their land.

How it works

When an energy developer seeks rights to your land, I review the proposed agreement, advise you on its terms, and negotiate on your behalf.

  1. Review the agreement

Energy agreements often exceed fifty pages, and the most consequential terms are rarely the obvious ones. I review the entire document, including any lease attached to an option.

  2. Advise you on its terms

You receive a written analysis of the compensation, the rights granted to the developer, the principal risks, and the terms worth negotiating. We then review it together.

  3. Negotiate on your behalf

I present your priorities to the developer and negotiate the provisions that matter most, including compensation, protections, and decommissioning, while keeping the transaction on track.
